INFORMACIÓN PRELIMINAR: NO SE REQUIERE COMPRA O PAGO ALGUNO PARA PARTICIPAR O GANAR. COMPRA O PAGO NO AUMENTARÁ SUS PROBABILIDADES DE GANAR. No es válido fuera del área geográfica terrestre de recepción de la señal de transmisión de WSNS y donde esté prohibido. El Sorteo de Boletos a Los Tigres del Norte (“Sorteo”) comienza el 9 de mayo del 2016 a las 10:00 P.M. y termina el 5 de junio del 2016 a las 11:59 P.M. CT (“Periodo del Sorteo”). Todas las horas en este Sorteo están indicadas en Horas del Centro (“CT”). Este Sorteo está sujeto a todas las leyes federales, estatales y locales que apliquen. Las probabilidades de ganar un Sorteo Individual dependen del número de inscripciones elegibles (como escrito por abajo) recibidas para cualquier Sorteo Individual (como escrito por abajo). Éste Sorteo está sujeto a todas las leyes federales, estatales y locales que apliquen.
ELEGIBILIDAD: Abierto solamente a los residentes legales permanentes de los EE.UU. que se encuentren físicamente domiciliados y residiendo en el área geográfica terrestre de recepción de la señal de transmisión de WSNS en los condados de Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, y Will en el estado de Illinois; Jasper, Lake, La Porte, Newton, and Porter en el estado de Indiana y que tengan al menos dieciocho (18) años cumplidos en la fecha de participar en el Sorteo. Los funcionarios, directivos y empleados de las Entidades del Sorteo (definidos abajo) y sus familiares más cercanos (cónyuges y/o padres, hijos/as y hermanos/as y sus respectivos cónyuges independientemente del domicilio en que residan) y/o personas residiendo en el mismo domicilio con dichas personas (relacionados o no relacionados familiarmente) no son elegibles para inscribirse y ganar el Sorteo. Las Entidades del Sorteo, como se las menciona aquí, incluirán WSNS, 1235 North Loop West, Houston, TX y Telemundo Network Group LLC, 2290 West 8th Avenue, Hialeah, FL 33010 (conjuntamente, “Patrocinadores”) Ravinia, 418 Sheridan Road, Highland Park, IL 60035 (“Proveedores de Premios”), Broadcast Interactive Media, y sus respectivas casas matrices, compañías afiliadas y subsidiarias y sus entes administrativos, de publicidad y promoción, y cualquier otra entidad involucrada en el desarrollo, administración, promoción o implementación del Sorteo.
PARA INSCRIBIRSE: Este Sorteo consiste de veinte (20) sorteos individuales ("Sorteos Individuales"), tal como es descrito en la tabla abajo y conducido durante el Periodo del Sorteo. Cada Sorteo Individual consiste de: (i) un periodo de promoción (“Período de Entrada”), como escrita en la tabla por abajo (cada uno con una “Fecha de Empezar Inscripciones” y una “Fecha de Terminar Inscripciones”; y (ii) un sorteo al azar que se llevara a cabo de la Fecha de Selección de Ganadores (“Fecha de Selección de Ganadores”) como escrita en la tabla por abajo de entre todas las Inscripciones elegibles recibidas para el correspondiente Sorteo Individual. Las Inscripciones para cada Sorteo Individual deben ser recibidas antes de la Fecha de Terminar Inscripciones correspondiente como escrita en la tabla abajo. Las Inscripciones para el último Sorteo Individual (Sorteo Individual 20) deberán recibirse antes de las 11:59 P.M. CT el 5 de mayo del 2016. El tiempo de su Inscripción determinar en qué Sorteo Individual es asumido.
Para entrar en el sorteo en línea durante uno de los Periodos de Sorteo, sintoniza a "Noticias Telemundo Chicago" en WSNS durante el Periodo del Sorteo, entre las 10:00 P.M. CT y 10:30 P.M. CT para obtener la palabra clave (la "Palabra Clave"). A continuación, acceda a la página web en www.telemundochicago.com/tu-telemundo/promociones (el "Sitio de Red") y haga clic en el icono del Sorteo, una vez allí llene y luego transmita el formulario de inscripción, el cual requiere su nombre completo, dirección, número telefónico, dirección de correo electrónico, fecha de nacimiento, y la Clave ("Inscripción"). No es necesario tener la Palabra Clave correcta para inscribirse en el Sorteo. Todas las Inscripciones pasan a ser propiedad de los Patrocinadores y no se acusará su recibo.

La computadora de los Patrocinadores será el dispositivo oficial para el control de puntualidad y para todo lo que al Sorteo se refiere. Límite de una (1) Inscripción por persona, por cada día, por cada correo electrónico. Las Inscripciones generadas por medio de subrutinas de software, macro, o cualquier otro método automatizado serán descalificadas. Las Inscripciones que por cualquier razón estén incompletas, corruptas, sean incomprensibles, o ininteligibles, en forma enunciativa mas no limitada a fallos o congestión de computadora o de la red, serán nulas y no se aceptarán. Si hubiese alguna disputa en lo que a la identidad de algún participante se refiere, el dueño autorizado del correo electrónico que se haya utilizado para inscribirse, será considerado el participante. El/la "dueño(a) autorizado de la cuenta" se define como la persona natural a la cual se le asigna una dirección de correo electrónico por parte del Proveedor de Servicio de Internet, proveedor de servicio en línea u otra organización (por ej., negocio, institución educativa, etc.) que fuese responsable por asignarle la dirección de correo electrónico para el dominio relacionado a la dirección de correo electrónico recibida. Excepto donde estuviese prohibido por ley, la Inscripción constituye permiso para usar el nombre del participante, la ciudad, el estado, su parecido, imagen, y/o su voz para fines de anuncios, promoción, y publicidad en todo medio conocido ahora o en adelante, en todo el mundo a perpetuidad, sin compensación adicional, notificación, permiso o autorización.
PRIVICIDAD: Los participantes podrán optar por recibir información de los Patrocinadores, marcando la casilla correspondiente. Cualquiera información personal será sujeto a la Política de Privacidad publicada en o http://www.nbcuniversal.com/privacy-spanish/. Si en cualquier momento no desea recibir materiales de parte del Patrocinador, favor de dirigirse a su Política de Privacidad y siga las indicaciones al respecto.
SELECCIÓN DE GANADORES Y NOTIFICACIÓN: Se selecciona a un (1) ganador (“Ganador(es)”) potencial por cada Sorteo Individual, de acuerdo a la Tabla de Sorteos arriba.
Un total de veinte (20) ganadores potenciales serán seleccionadas durante el Periodo del Sorteo. Cada uno de los ganadores potenciales será seleccionado en un sorteo al azar, por los Patrocinadores o representantes, siendo tales decisiones firmes y vinculantes en todo asunto al que a este Sorteo se refiere, en o alrededor de las fechas indicadas en la tabla por cada Sorteo Individual. Los Patrocinadores harán dos (2) intentos de notificar al Ganador/es al número de teléfono y/o dirección de correo electrónico presentado al momento de la inscripción. Se podrá exigir al Ganador que firme y devuelva una declaración jurada de elegibilidad, un relevo de responsabilidad y, excepto donde esté prohibido, un relevo de publicidad completados, firmados y notariados (conjuntamente “Documentos del Sorteo”) dentro de dos (2) días de tal notificación. El incumplimiento de este requisito en el periodo de tiempo indicado resultará en la descalificación y, en el exclusivo discreción de los Patrocinadores, se seleccionará un Ganador alterno para la entrega del premio. Si no se puede ubicar al Ganador, si se determina que no es elegible o no cumple o no puede cumplir con estas Reglas Oficiales, o si se devuelve el premio o la notificación del premio por ser imposible de entregar, se descalificará a dicho Ganador eventual y se podrá seleccionar, en el exclusivo discreción de los Patrocinadores, en su reemplazo a otro Ganador eventual entre las Inscripciones elegibles restantes. Las Inscripciones recibidas para cualquier Sorteo Individual no se conservarán para Sorteos Individuales siguientes. Limitado a un (1) premio por persona, familia o residencia. Podrá exigirse que el Ganador reclama su Premio en las oficinas de WSNS.
PREMIO: Se otorgará un total de veinte (20) premios (“Premio(s)”). Cada Premio, para cada Sorteo Individual, consiste de un (1) boleto para el Ganador y un (1) boleto para un invitado (“Invitado(s)”) para el Concierto de Los Tigres del Norte en Highland Park, IL y que se llevara a cabo del 17 de septiembre del 2016 (“Evento”). NO ESTACIONAMIENTO O TRANSPORTE ESTA INCLUIDO COMO PARTE DEL PREMIO. El Valor Minorista Estimado (“ERV” por sus siglas en inglés) del Premio es cincuenta dólares ($50.00). El ERV de todos los Premios es mil dólares ($1000.00). El Valor Retal Actual (“ARV” por sus siglas en inglés) puede variar. No se otorgará ninguna diferencia entre el ERV y ARV. Para cualquier Premio con un ARV de seiscientos dólares ($600) o más, los Patrocinadores proporcionarán un formulario 1099 del Departamento de Recaudación de Impuestos de EE. UU. (“IRS” pos sus siglas en inglés) para el año en que ganó el Premio.
Los Patrocinadores/Proveedores de Premio harán todos los arreglos relacionados con los Premios a su exclusiva discreción. Los Patrocinadores/Proveedores de Premio se reservan el derecho a sustituir el Premio (o parte/s del Premio) por otro similar de igual o mayor valor, a su absoluta discreción. Los impuestos y demás gastos, costos o cargos relacionados con la aceptación y/o uso del Premio son responsabilidad exclusiva del Ganador. El Premio no puede ser transferido por el Ganador ni canjeado por dinero en efectivo, y es válido solamente por los servicios detallados más arriba sin que se permitan sustituciones de Premio por parte del Ganador. Si un Premio no es reclamado, será perdido y los Patrocinadores seleccionarán al azar a un nuevo Ganador sustituto. Si alguna parte del Premio no estuviera disponible por cualquier motivo, las demás partes del Premio constituirán cumplimiento pleno de la responsabilidad de los Patrocinadores hacia el Ganador con relación al Premio y no se adjudicará ninguna compensación adicional.
Los Patrocinadores/Proveedores de Premio no serán responsables por cancelaciones y/o retrasos ni por cambios por parte de empresas o personas proporcionando cualquier parte del Premio debido a motivos más allá de su control y no serán responsables por gastos incurridos como consecuencia de los mismos. Las Entradas están sujetos a términos adicionales y condiciones impresos en los mismos. La fecha y/u hora de la presentación, y la presentación están sujetas a cambios y a cancelación. Si el Ganador elige asistir al Evento con menos de un (1) invitado, las partes restantes del Premio constituirán pleno cumplimiento de la obligación de los Patrocinadores hacia el Ganador con relación al Premio y no se adjudicará ninguna compensación adicional. El Invitado, de haberlo, deberá completar relevos de responsabilidad y, excepto donde esté prohibido, de publicidad (conjuntamente, los “Documentos del Invitado”), los cuales deberán ser devueltos junto a los Documentos del Sorteo o el Premio será perdido y se seleccionará a un Ganador sustituto.
CONDICIONES: Al inscribirse en este Sorteo, los participantes acuerdan, en nombre propio y en nombre y en representación de sus herederos, albaceas y administradores: (a) relevar y amparar a las Entidades del Sorteo, y a sus respectivos funcionarios, directivos y empleados, (conjuntamente, las “Partes Relevadas”) contra toda responsabilidad, enfermedad, lesión, muerte, pérdida, pleito, o daños y perjuicios que pudieran suceder, directa o indirectamente, causados por negligencia o por cualquier otro motivo resultando de su participación en este Sorteo y/o de su aceptación, o uso debido o indebido del Premio o cualquier parte del Premio; (b) indemnizar a las Partes Relevadas contra toda responsabilidad resultando o surgiendo del Sorteo y por este medio reconocer que las Partes Relevadas no han de ningún modo hecho, ni son responsables por extender, garantías o declaraciones expresas o implícitas, de hecho o en ley, relativas a los Premios, incluyendo cualquier garantía expresa extendida exclusivamente por el proveedor mediante su entrega de los Premios; (c) de ser seleccionado como Ganador, a la publicación de su nombre/s y apellido/s, de ser Ganador, en el Sitio de Red y que las Partes Relevadas usen su/s nombre/s y apellido/s, voz, imagen y/o semejanza en publicidad, promociones y campañas publicitarias en cualquier y todo medio ahora conocido o por ser conocido a través del mundo en perpetuidad sin compensación adicional alguna, notificación, permiso o aprobación y, a petición, a consentir, por escrito, a tal uso; y (d) a cumplir con estas Reglas Oficiales y a renunciar al derecho a reclamos por ambigüedad o error en estas Reglas Oficiales o en el Sorteo y a someterse a las decisiones de los jurados y/o Patrocinadores, las cuales son de carácter vinculante y final. El incumplimiento de cualquier término de estas Reglas Oficiales podrá resultar en la descalificación de este Sorteo.
CONDICIONES ADICIONALES: Los Patrocinadores se reservan el derecho a descalificar permanentemente de cualquier promoción (incluyendo esta) a cualquier persona que estos crean haya violado deliberadamente estas Reglas Oficiales. Cualquier intento deliberado de dañar el Sorteo o su operación, es ilícito y está sujeto a acción legal por parte de los Patrocinadores, quienes podrán procurar reparación por daños y perjuicios en la medida máxima permitida por ley. El incumplimiento de cualquier cláusula de estas Reglas Oficiales por parte de los Patrocinadores debido a un caso fortuito, huracán, guerra, incendio, disturbio social, terremoto, amenaza o actividad terrorista, maniobra de enemigos públicos, decisiones de autoridades gubernamentales fuera del control de los Patrocinadores (excepto cumplimiento de normas y regulaciones vigentes) y todo otro hecho de fuerza mayor, no serán considerados violaciones de estas Reglas Oficiales. Las Partes Relevadas no asumen ningún tipo de responsabilidad por perjuicio o daño a la computadora del participante o de terceros, relacionados con o resultando de la Inscripción o de bajar materiales o software del Internet para participar en el Sorteo. Las Partes Relevadas no son responsables por fallas de ningún tipo en las telecomunicaciones o redes, fallas electrónicas, técnicas o de computadora, trascripción errónea de información de Inscripción, error en material promocional o de mercadeo, error en estas Reglas Oficiales, o cualquier error humano o electrónico en la administración de este Sorteo o estos Premios, o por Inscripciones que sean robadas, mal dirigidas, alteradas o devueltas. Los Patrocinadores se reservan el derecho de cancelar, modificar o suspender el Sorteo o cualquier parte del mismo (incluyendo sin limitaciones estas Reglas Oficiales) sin ningún tipo de notificación y con cualquier motivo (incluyendo sin limitaciones en caso de alguna situación inesperada no contemplada en estas Reglas Oficiales). En caso de cancelación, modificación, o suspensión, los Patrocinadores se reservan el derecho a seleccionar a los Ganadores mediante un Sorteo al azar de entre todas las inscripciones elegibles que no estén bajo sospecha y hayan sido recibidas hasta el momento de que se haya producido la situación que requiere dicha cancelación, modificación, o suspensión. El aviso de dicha cancelación, modificación, o suspensión será publicada el Sitio de Red. Los Patrocinadores podrán prohibir la participación en este Sorteo, si el participante, o participante potencial: demuestra indiferencia o no respeta estas Reglas Oficiales; exhibe una conducta desplegada para molestar, abusar, amenazar o acosar a otro participante, a los Patrocinadores, agentes o representantes de los Patrocinadores, o si se comporta de manera perjudicial (tal y como lo interpreten los Patrocinadores a su exclusiva discreción).
CONFLICTOS: ESTE SORTEO ESTÁ REGIDO POR E INTERPRETADO SEGÚN LAS LEYES DE LA FLORIDA Y EL FORO Y LUGAR DESIGNADO PARA RESOLVER CONFLICTOS ESTARÁ UBICADO EN LA CIUDAD DE MIAMI, FLORIDA. SI UN CONFLICTO O RECLAMO NO PUEDE SER RESUELTO POR CONVERSACIONES DIRECTAS O MEDIACIÓN, TAL CONFLICTO SERÁ RESUELTO MEDIANTE ARBITRAJE FINAL Y VINCULANTE ADMINISTRADO POR JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., (“JAMS” POR SU SIGLA EN INGLÉS) SEGÚN SUS REGLAS Y PROCEDIMIENTOS SIMPLES O SEGÚN VERSIONES POSTERIORES DE LAS MISMAS (“REGLAS JAMS”). LAS REGLAS JAMS SERÁN RESPETADAS PARA EL PROCESO DE SELECCIÓN DE ÁRBITRO, EXCEPTO QUE DICHO ÁRBITRO DEBERÁ TENER EXPERIENCIA LEGAL Y LICENCIA PARA PRACTICAR DERECHO EN LA FLORIDA. LOS JUICIOS INICIADOS SEGÚN ESTE PÁRRAFO TOMARÁN LUGAR EN EL CONDADO DE MIAMI-DADE. LA REPARACIÓN/REMEDIO DE RECLAMOS ESTARÁ LIMITADA A DAÑOS Y PERJUICIOS SUFRIDOS ÚNICAMENTE, Y NINGUNA DE LAS PARTES Y EN NINGUN CASO, TENDRÁ DERECHO A RECOBRAR DAÑOS PUNITORIOS, EJEMPLARES, INCIDENTALES O INDIRECTOS, INCLUYENDO HONORARIOS DE ABOGADO/S, O CUALQUIER OTRO GASTO SIMILAR RELACIONADO CON LA PRESENTACIÓN DE UN RECLAMO, O A RESCINDIR ESTE ACUERDO O A PROCURAR MEDIDAS CAUTELARES O RECURSOS DE EQUIDAD.

PRELIMINARY INFORMATION: NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. Void outside the WSNS terrestrial geographic viewing area and where prohibited. The Sweepstakes for Tickets to Los Tigres del Norte (“Sweepstakes”) will begin on May 9, 2016 at 10:00 P.M. CT and end on June 5, 2016 at 11:59 P.M. CT (“Sweepstakes Period”). All times in the Sweepstakes refer to Central Time (“CT”). Odds of winning depend upon the number of eligible Entries received (for Individual Sweepstakes as described below) during the Entry Period (for each Individual Sweepstakes as described below). Sweepstakes is subject to all applicable federal, state and local laws.
ELIGIBILITY: Open only to permanent, legal United States (“U.S.”) residents who are physically located in the WSNS terrestrial geographic viewing area in the counties of Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, and Will in the state of Illinois; Jasper, Lake, La Porte, Newton, and Porter in the state of Indiana and who are eighteen (18) years of age or older as of the date of participation in the Sweepstakes. Officers, directors, and employees of Sweepstakes Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include WSNS-TV Telemundo 47, 1235 North Loop West, Houston, TX 77008 and Telemundo Network Group, LLC, 2290 West 8th Avenue, Hialeah, FL 33010, (collectively, “Sponsors”), Ravinia Festival Association, 418 Sheridan Road, Highland Park, IL 60035 (“Prize Provider”), Broadcast Interactive Media, and their respective parent, subsidiary, and affiliate companies and administrative, advertising, and promotion agencies and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.
TO ENTER: The Sweepstakes consists of twenty (20) Individual Sweepstakes (each an “Individual Sweepstake”), as detailed in the chart below and conducted during the Sweepstakes Period. Each Individual Sweepstake will consist of: (i) a promotion period (an “Entry Period”) as detailed in the chart below (each with a “Start Date” and an “End Date”); and (ii) an Individual Sweepstake conducted on the Individual Sweepstake date (“Individual Sweepstake Date”) specified in the chart below from among all eligible Entries received during the corresponding Entry Period. Entries for each Individual Sweepstake must be received by the Entry Period End Date for the corresponding Entry Period as specified in the chart below. Entries for the last Individual Sweepstake (Individual Sweepstake 20) must be received by 11:59 P.M. CT on June 5, 2016. The timing of your Entries will determine which Individual Sweepstake they are entered into.

Then visit the web page located at www.telemundochicago.com/tu-telemundo/promociones (the “Website”) and access the Sweepstakes tab (“Sweepstakes Tab”). Then follow the provided instructions to complete and thereafter submit the entry form, which includes your name, address, email address, date of birth and Clue Word (“Entry”). The correct clue word is not required to enter the Sweepstakes. All entries become the property of Sponsors and will not be acknowledged or returned.

Sponsors’ computer shall be the official timekeeper for all matters related to this Sweepstakes. You may enter only once per person/per email/per day. Multiple Entries received beyond the stated limit will void all such additional Entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to computer or network malfunction or congestion, are void and will not be accepted. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter, if applicable, will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Service Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Except where prohibited by law, Entry constitutes permission to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity without additional compensation.
PRIVACY: Online Entrants will have the opportunity to receive information from Sponsors by checking the appropriate box(es). Any personal information supplied by entrants to Sponsors will be subject to Sponsors’ respective Privacy Policies posted at http://www.nbcuniversal.com/privacy-spanish. If, at any time, you no longer wish to receive materials from Sponsors, please go to their respective Privacy Policies (as listed above) or the applicable partner’s privacy policy and follow the procedures indicated.
WINNER SELECTION AND NOTIFICATION: One (1) potential winners (“Winner”) will be selected in each Individual Sweepstake according to the Sweepstakes Table above.
A total of twenty (20) potential Winners will be selected during the Sweepstakes Period. Each potential Winner will be selected, in a random drawing, on or about the Individual Sweepstake Dates specified in the chart above, from among all eligible Entries received during the corresponding Entry Period by employees or representatives of Sponsors, whose decisions are final and binding with respect to all matters related to the Sweepstakes. Sponsors will make two (2) attempts to notify potential Winners at the phone numbers and/or email addresses submitted at the time of Entry. Potential Winners may be required to execute and return affidavits of eligibility, releases of liability, and, except where prohibited, publicity releases (collectively, “Sweepstakes Documents”) within two (2) days of such notification. Noncompliance within this time period will result in disqualification, and, at Sponsors’ sole discretion an alternate potential Winner may be selected from the remaining eligible Entries from the applicable Entry Period. If a potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if prize or prize notification is returned as undeliverable, such potential Winner will be disqualified and time permitting, at Sponsors’ sole discretion, an alternate potential Winner may be selected in a random drawing from the remaining eligible Entries. The entries for each Individual Sweepstakes do not roll over to subsequent Individual Sweepstakes. Limit one (1) Prize per family or household. Winner may be required to claim prize at the offices of WSNS.
PRIZE: There will be a total of twenty (20) prizes awarded (“Prize(s)”). There will be one (1) prize (“Prize(s)”) awarded for each Individual Sweepstakes consisting of the following: one (1) ticket for the Winner and one (1) ticket for a guest (“Guest(s)”) to the Los Tigres del Norte Concert that will take place on September 17, 2016 in Highland Park, IL (“Event”). NO PARKING OR TRANSPORTATION IS INCLUDED AS A PART OF THE PRIZE. The estimated retail value ("ERV") of the prize is fifty dollars ($50.00). The ERV of all prizes is one thousand dollars ($1000.00). The actual retail value ("ARV") may vary. Any difference between the ERV and ARV will not be awarded. For any prize with an ARV of six hundred dollars ($600) or more, sponsors will provide a form 1099 from the U.S. Department of Revenue ("IRS") for the year that the Winner won the Prize.
Specifics of Prize will be determined by Sponsors/Prize Providers in their sole discretion. Sponsors/Prize Providers reserve the right to substitute a similar Prize (or Prize element) of equal or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed, it will be forfeited, and an alternate Winner may be selected from the remaining eligible entries. If a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner, and no additional compensation will be awarded.
Sponsors/Prize Providers shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event is subject to change. Event is subject to cancellation. If Winner chooses to attend the Event with no Guests, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, may be required to execute and return releases of liability and, except where prohibited, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Prize will be forfeited and an alternate winner may be selected from the remaining eligible entries.
CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities, and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on the Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes at Sponsors’ sole discretion.
ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winner(s) in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on Website. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).
DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF FLORIDA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN MIAMI, FLORIDA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN FLORIDA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF MIAMI-DADE. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
