Sorteo Miss Universo Puerto Rico de Verizon Wireless Reglas Oficiales / Bases del Sorteo Del 3 al 7 de noviembre 2009

INFORMACIÓN GENERAL: no es necesario comprar. La compra no mejora las probabilidades de ganar. No es válido afuera del área geográfica terrestre de recepción de la señal de transmisión de WSNS Telemundo Chicago (como se define abajo) y donde esté prohibido. El Sorteo Miss Universo Puerto Rico (“Sorteo”) comienza el 3 de noviembre 2009 a las 12.00 del mediodía y finaliza el 7 de noviembre 2009 a las 2.00 de la tarde (“Periodo del Sorteo”). Todas las horas de este Sorteo están indicadas como Hora/s Estándar del Centro de los EE.UU. Las probabilidades de ganar dependen del número de inscripciones elegibles recibidas. El Sorteo está sujeto a todas las leyes federales, estatales y locales vigentes.

ELEGIBILIDAD: este Sorteo está abierto solamente para los residentes legales permanentes de los EE.UU. físicamente localizados y residiendo en el área geográfica terrestre de recepción de la señal de transmisión de WSNS Telemundo Chicago en los condados de Cook, Dupage, Will, Lake, Kane, Kendall, Grundy, McHenery, Dekalb, La Sallle and Kankakee - en Illinois, y en los condados de Lake, Porter, Newton, Jasper y La Porte en Indiana. Para ser elegible, usted debe ser mayor de dieciocho (18) años de edad al comenzar el Periodo del Sorteo y tener un pasaporte vigente expedido por autoridad competente que cumpla con los requisitos del Departamento de Estado de los EE.UU. en cuanto a la validez de documentos para viajar internacionalmente y reingresar a los EE.UU., o una Tarjeta de Residencia (en inglés, Green Card) para los residentes permanentes de los EE.UU.; o una copia certificada de su acta de nacimiento y un documento de identidad con foto expedido por autoridad competente para los ciudadanos de EE.UU., o un Certificado de naturalización expedido por el Servicio de Inmigración de los EE.UU. Los funcionarios, directivos y empleados de las Entidades del Sorteo y sus familiares inmediatos (esposos, padres/madres, hijos/hijas, hermanos/ hermanas y sus esposos) y toda otra persona que resida en la misma residencia con aquellos, emparentados o no, no son elegibles para inscribirse en el Sorteo. Las Entidades del Sorteo, tal y como son mencionadas aquí, incluyen a los Patrocinadores sus respectivas casas matrices, sus empresas subsidiarias y afiliadas y sus agencias administrativas, de publicidad y promoción y cualquier otra entidad participando en el desarrollo, administración, promoción o implementación del Sorteo. PARA INSCRIBIRSE: Hay dos (2) métodos de inscripción. Durante el Periodo del Sorteo, visite la tienda participante de Verizon Wireless ubicada en Aurora, Illinois, en el 740 North Route 59 unit B 60504 (“Tienda”) para obtener un formulario de inscripción. Complete el formulario de inscripción con su/s nombre/s y apellido/s, domicilio, edad, número de teléfono particular y número de teléfono celular/móvil (“Inscripción”) y preséntelo colocándolo en la caja de inscripciones localizada en la Tienda. Las Inscripciones deberán ser recibidas antes de las 2.00 de la tarde del 7 de noviembre, 2009. Las Inscripciones pasan a ser propiedad de los Patrocinadores, no se acusará su recibo y no serán devueltas. El horario de atención al público de la Tienda es de lunes a sábado de 9.00 de la mañana a 8.00 de la noche y domingos de 11.00 de la mañana a 6.00 de la tarde. El Segundo método de inscripción es enviando un sobre con sus datos y franqueo pre-pagado a Telemundo 39, c/o Mexico v Colombia en Dallas Sweepstakes, 3900 Barnett St., Fort Worth, TX 76103 incluyendo su inscripción (nombre/s y apellido/s, domicilio, edad, número de teléfono particular y número de teléfono celular). Podrá inscribirse una vez al día durante el Periodo del Sorteo. Las inscripciones múltiples recibidas de cualquier persona que excedan este límite quedarán anuladas. Las Inscripciones que estén incompletas, ilegibles, alteradas o que sean confusas por cualquier motivo quedan anuladas y no serán aceptadas. La inscripción constituye autorización (excepto donde lo prohíba la ley) para usar nombre/s y apellido/s, ciudad, estado, parecido, semejanza, imagen y/o voz del ganador en campañas publicitarias, promociones y propaganda sin compensación adicional.

SELECCIÓN DEL GANADOR Y NOTIFICACIÓN: el o alrededor del 9 de noviembre 2009, entre las 10.00 de la mañana y las 2.30 de la tarde, un (1) ganador (“ganador”) será seleccionado al azar por empleados de los Patrocinadores de entre todas las inscripciones elegibles recibidas. Después que el ganador sea seleccionado el o alrededor del 9 de noviembre 2009, los Patrocinadores harán dos (2) intentos por notificar al ganador llamando al número de teléfono proporcionado al momento de la inscripción y verificar su elegibilidad. El ganador debe ser declarado elegible y estar dispuesto a aceptar el premio dentro de las veinticuatro horas de haber recibido la notificación. Si el ganador no confirma su aceptación del premio dentro del tiempo indicado, será descalificado y se podrá seleccionar al azar a un ganador sustituto de entre las demás inscripciones elegibles. Para aceptar y reclamar el premio, el ganador debe dirigirse en persona a la oficina de WSNS Telemundo Chicago, ubicada en el 454 N. Columbus Drive, 5to piso, Chicago, IL 60611 el día 14 de agosto 2009 a la hora especificada por los Patrocinadores. Al reclamar el premio el día 10 de noviembre 2009, se exigirá al ganador que presente un pasaporte en vigencia expedido por autoridad competente para confirmar su elegibilidad y habilidad de cumplir con los requisitos de documentación internacional para el viaje. En ese momento, también se exigirá al ganador que firme y devuelva una declaración jurada de elegibilidad, un relevo de responsabilidad y, excepto donde esté prohibido, un relevo de publicidad (conjuntamente los “Documentos del Sorteo”). El incumplimiento de cualquiera de estos requisitos resultará en descalificación y se podrá seleccionar al azar, de entre las demás inscripciones elegibles, a un ganador sustituto. Si se descubre que el ganador es inelegible y/o si no puede y/o no desea cumplir con estas Reglas Oficiales, el ganador será descalificado inmediatamente y se podrá seleccionar a un ganador sustituto de entre las demás inscripciones elegibles recibidas. Limitado a un (1) premio por familia o unidad familiar.

PREMIO: se entregará un (1) premio. (“Premio”) que incluye un viaje a San Juan Puerto Rico (“Viaje”), pasajes de ida y vuelta en clase económica para dos personas (2 Adultos mayores de 18 años de edad al momento de salir de viaje) de Chicago a San Juan, Puerto Rico; alojamiento en hotel por dos noches (que incluye una habitación para los dos adultos que viajan) por tres noches/cuatro días del 11 al 14 de noviembre 2009 en el hotel Caribe Hilton (el hotel está sujeto a disponibilidad y cambios), y dos entradas al evento de Miss Universo Puerto Rico el dia jueves 12 de noviembre, 2009 y la fiesta después del evento. Se entregará al ganador una tarjeta-obsequio de American Express por $500.00 para cubrir sus gastos menores varios (gastos incidentales) y sus traslados por tierra entre el aeropuerto y el hotel en San Juan, el traslado al centro de convenciones desde el hotel ida y vuelta y las comidas para dos personas durante la estadía. El premio está sujeto a disponibilidad de reservas y podrá ser cambiado a exclusiva discreción de los Patrocinadores. El Valor Calculado Minorista (“ERV” por su sigla en inglés) del Premio es de tres mil dólares ($3,000). Los Patrocinadores entregarán al Ganador un formulario 1099 del Servicio Interno de Rentas (“IRS” por su sigla en inglés) equivalente al ERV del Premio correspondiente al año fiscal en que el Premio haya sido ganado. Los Patrocinadores controlarán todos los detalles relacionados con los premios a su exclusiva discreción. Además, los Patrocinadores se reservan el derecho a sustituir el premio (o parte del premio) por otro de igual o mayor valor. Los impuestos, gastos, costos o tasas relacionadas con la aceptación y/o uso del premio son responsabilidad exclusiva del ganador. El premio no puede ser transferido por el ganador o canjeado por dinero en efectivo y es válido exclusivamente como se detalla más arriba, sin sustituciones de premio permitidas al ganador. Si el premio no es reclamado será perdido y se seleccionará a un ganador sustituto de entre las inscripciones elegibles restantes. Si una parte de un premio no está disponible por cualquier motivo, entonces las demás partes del mismo constituirán cumplimiento pleno de la obligación de los Patrocinadores hacia el ganador y no se adjudicará compensación adicional. El viaje deberá ser concretado entre el 11 y 14 de noviembre, 2009. Ciertos periodos de veda y restricciones de viaje pudieran aplicar. El viaje, incluyendo pero no limitado al crucero y otros arreglos serán hechos por los Patrocinadores a su exclusiva discreción. El viaje debe concretarse en las fechas y horas designadas por los Patrocinadores o el premio será perdido y se podrá seleccionar a un ganador sustituto de entre las demás inscripciones elegibles. Una vez establecidas, no se permitirán cambios, extensiones o sustituciones de las fechas u horas de viaje excepto por parte de los Patrocinadores y a su exclusiva discreción. El ganador e invitado deberán viajar juntos en el mismo itinerario. El Premio incluye lo mencionado arriba solamente y nada más - los cargos de equipaje, seguros, gasolina, bebidas, propinas, tasas portuarias, excursiones en tierra, souvenirs y otros gastos o actividades incidentales no están incluidos. Los pasajes no son reembolsables. Las reservaciones están sujetas a disponibilidad. Los pasajes no son válidos para viajes de negocios o viajes en grupo. Los pasajes son válidos únicamente en la línea aérea seleccionada por los Patrocinadores a su exclusiva discreción. El viaje deberá ser concretado antes del 14 de noviembre, 2009. Los pasajes serán emitidos solamente a nombre del ganador e invitado y quedarán anulados si son vendidos o canjeados por alguna otra cosa de valor. El ganador es responsable de pagar toda responsabilidad arancelaria (incluyendo impuestos o tarifas de salida), cargos de inspección y cargos de seguridad. Una vez emitidos, los pasajes no son transferibles y no podrán ser reemitidos una vez que el viaje haya comenzado. Los arreglos de viaje deberán ser hechos a través de los Patrocinadores. El ganador e invitado deberán tener documentos de viaje en regla antes de la salida. La falta de documentación en regla resultará en perdida del premio. El viaje no podrá ser combinado con ninguna otra oferta y pudiera no calificar para programas de millas de viajero frecuente o puntos de hotel. El viaje en su totalidad es tomado a riesgo del ganador e invitado. Los Patrocinadores no reemplazarán pasajes, cupones o certificados perdidos o robados. El premio debe ser reclamado en su totalidad en el momento del reclamo. En caso de un acto fortuito, imprevisto o incontrolable, los Patrocinadores se reservan el derecho a postergar el viaje para otra fecha. Si el Ganador elije viajar con menos de un (1) invitado, o sin invitado, los elementos restantes del Premio constituirán cumplimiento pleno de la obligación de los Patrocinadores hacia el Ganador en cuanto al Premio y no se otorgará ninguna compensación adicional. Se podrá exigir al Invitado, de haberlo, que firme y cumplimente relevos de responsabilidad y, excepto donde esté prohibido, relevos de publicidad (conjuntamente los “Documentos del Invitado) y devolverlos junto con los Documentos del Sorteo, o el Premio será perdido y se seleccionará a un Ganador sustituto de entre las inscripciones elegibles restantes. CONDICIONES: inscribiéndose en este Sorteo los participantes acuerdan, en nombre propio y en representación de sus herederos, albaceas y administradores, (a) relevar y amparar a las Entidades del Sorteo y a sus respectivos funcionarios, directivos y empleados (conjuntamente las “Partes Relevadas”) contra toda responsabilidad, enfermedad, lesión, fallecimiento, pérdida, pleito o daño y perjuicio que pudiera ocurrir, directa o indirectamente, con o sin negligencia, de su participación en este Sorteo y/o de su aceptación, posesión, buen o mal uso del Premio o cualquier parte del Premio; (b) indemnizar a las Partes Relevadas contra cualquier y toda responsabilidad resultando o surgiendo del Sorteo y por el presente documento reconocer que las Partes Relevadas no han hecho ni son responsables de ningún modo de extender garantía alguna, implícita o explicita, de hecho o en ley, relacionada con los Premios incluyendo garantías extendidas exclusivamente por el proveedor del Premio que acompañan al Premio; (c) de ser elegido Ganador, permitir la divulgación de su/s nombre/s y apellido/s por WSNS Telemundo Chicago y todo uso que las Partes Relevadas hagan de su/ nombre/s y apellido/s, voz, imagen y/o parecido y semejanza en campañas publicitarias, promociones y publicidad sin compensación adicional y ante cualquier solicitud a autorizar por escrito tal uso, y (d) respetar estas Reglas Oficiales renunciando a cualquier derecho a reclamar ambigüedad o error en las mismas, o en el propio Sorteo, y respetar las decisiones de los Patrocinadores las cuales son de carácter vinculante y final en todos los asuntos y todos los sentidos. The second method of entry is to send a self-addressed stamped envelope to Telemundo 39, c/o Mexico v Colombia en Dallas Sweepstakes, 3900 Barnett St., Fort Worth, TX 76103 that includes your Entry (name, address, age, telephone number, and cellular phone). You may enter once per day during the Sweepstakes Period. Multiple Entries received from any person beyond this limit will void all such additional Entries. Entries that are incomplete or unintelligible for any reason are void and will not be accepted. Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity without additional compensation.

WINNER SELECTION AND NOTIFICATION: On or about November 9, 2009, between 10 A.M. and 2:30 P.M., one (1) winner (“Winner”) will be randomly selected by employees of Sponsors from all eligible Entries received. After the Winner is selected on or about November 9, 2009, Sponsors will make two (2) attempts to contact Winner at the telephone number provided at the time of entry to notify the Winner and verify his/her eligibility. Winner’s eligibility and willingness to accept the prize must occur within twenty-four (24) hours of notification. Winner’s failure to confirm acceptance of the prize within the specified time will result in his/her disqualification and an alternate winner may be randomly selected from the remaining eligible Entries. To accept and claim the prize, Winner must go to the WSNS Telemundo Chicago office, located at 454 N. Columbus Drive, 5th Floor, Chicago, IL 60611 on November 10, 2009 at the time specified by the Sponsors. At the time of claiming the prize on November 10, 2009, Winner will be required to present a valid government-issued passport or other forms of ID as specified above to confirm eligibility and ability to comply with U.S. Territory travel document requirements. At that time, Winner will also be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”). Noncompliance with any of the above requirements will result in disqualification, and an alternate winner may be randomly selected from the remaining eligible Entries. If Winner is found to be ineligible, and/or if he/she cannot or does not comply with these Official Rules, Winner will be immediately disqualified and an alternate winner may be randomly selected from the remaining eligible Entries. Limit one (1) prize per family or household.

PRIZE: There will be a total of one (1) prize awarded. (“Prize”). The Prize consists of a trip to San Juan Puerto Rico (“Trip”). The Trip consists of round-trip airfare for two people (2 Adults that are 18 years and older at the time of travel) from Chicago to San Juan, Puerto Rico; hotel accommodations for two (which includes one room for the two adults traveling) for three nights/four days from November 11 – November 14 2009 at the Caribe Hilton (hotel subject to availability and change); and two tickets to the Miss Universe Puerto Rico event on Thursday, November 12, 2009 and the after party. A $500.00 American Express gift card will be given to the winner to cover incidental expenses and transportation transfers such as the transfer from airport to hotel in San Juan, transfer to the convention center from the hotel & return and meals for two people during stay. Prize is subject to booking availability and may be changed at the Sponsor’s sole discretion. The Estimated Retail Value (“ERV”) of the Prize is Three Thousand dollars ($3,000). Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the ERV of Prize for the tax year in which Prize was awarded. Specifics of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a similar Prize (or Prize element) of equal or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed, it will be forfeited, and an alternate Winner may be selected from the remaining eligible Entries. If a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner, and no additional compensation will be awarded. Trip must occur from November 11 to November 14, 2009. Certain blackout periods and travel restrictions may apply. Trip, including but not limited to travel and hotel arrangements, will be determined by Sponsors in their sole discretion. Travel must occur on dates and times designated by Sponsors or Prize will be forfeited and an alternate winner may be selected from the remaining eligible Entries. Once determined, no change, extension, or substitution of travel dates and/or times is permitted, except by Sponsors in their sole discretion. Winner and Guests must travel together on the same itinerary. Prize consists only of the elements set forth above. No other travel elements (including, without limitation, luggage fees, insurance, gasoline, meals, gratuities, souvenirs and other incidentals or activities) are included in Prize. Tickets are non-refundable. Reservations are subject to availability. Tickets are not valid for business-related or group travel. Tickets are valid only for travel on airline chosen by Sponsors in their sole discretion. All travel must be completed by November 14, 2009. Tickets will be issued only to Winner and Guest. Tickets are void if sold for cash or other consideration. Winner is responsible for any tax liability (including applicable departure taxes or fees), inspection charges, and security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Travel arrangements must be made through Sponsors. Winner and Guests must have valid travel documents prior to departure. Failure to provide documentation will result in forfeiture of Prize. Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Travel may not be combined with any other offer and may not qualify for frequent flyer miles or hotel points. All travel will be at the risk of Winner and Guests. Sponsors will not replace any lost or stolen tickets, vouchers, or certificates. All elements of Prize must be redeemed at the same time. In the event of an act of God or an unforeseen, uncontrollable event, Sponsors reserve the right to reschedule all travel for a later date. If Winner chooses to travel with fewer than One (1) Guest, or no Guest, the remaining elements of the Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guests, if any, may be required to execute and return releases of liability and, except where prohibited, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Prize will be forfeited and an alternate winner may be selected from the remaining eligible Entries. If any Guest is a minor, Winner or one of the other Guests must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf. The U.S. State Department requires all U.S. Territory travelers to present a government-issued passport or other approved documents noted above to U.S. Customs for re-entry after air, land, or sea travel. CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the or Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the announcing of such entrant’s name on WSNS Telemundo Chicago and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes.

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer or wireless device relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received at the time of the event warranting such cancellation, modification, or suspension. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).

DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF ILLINOIS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN MIAMI, FLORIDA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN ILLINOIS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF COOK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
